The Song-Beverly Consumer Warranty Act provides strong protections for California consumers.
The 18/18 Presumption
If your vehicle’s defects occurred within 18 months of purchase or 18,000 miles (whichever comes first), and the manufacturer cannot repair it, there’s a legal presumption it’s a lemon.
Repair Attempts
Generally, 2 or more repair attempts for the same serious defect, or 4+ attempts for any defect, may qualify. One attempt for safety issues may be enough.
30-Day Rule
If your vehicle has been out of service for repairs for 30 or more days (cumulative), it may qualify as a lemon regardless of the number of repair attempts.
Warranty Coverage
The defect must have occurred while under the manufacturer’s warranty. This includes original warranties, extended warranties, and certified pre-owned warranties.
